The ACHE Exam Online Community (the "Site") and its contents are owned by the American College of Healthcare Executives (ACHE). By using the Site you signify that you have read, understood and agree to be bound by these Terms of Usage. ACHE reserves the right to change these Terms of Usage at any time without further notice. The changes will be posted on this Terms of Usage page and the last revision date will be updated. Your continued use of the Site after such changes indicates your acceptance of the new Terms of Usage. It is your responsibility to regularly check the Site to determine if there have been changes.

The Site content reflects the views of individual participants only. ACHE and its representatives bear no responsibility for the accuracy of participant comments and will bear no legal liability for discussion results. ACHE is not responsible for the conduct, whether online or offline, of any user of the Site. Under no circumstances will ACHE be responsible for any loss or damage to any User Content or personal injury or death, resulting from anyone’ s use of the Site or any interactions between users of the Site, whether online or offline.

ACHE is not responsible for and makes no warranties, express or implied, as to any information contained in user profiles ("User Content") or the accuracy or reliability of the User Content posted on the Site, whether caused by users of the Site or by any of the equipment or programming associated with or utilized in the Site and such User Content does not necessarily reflect the opinions or policies or ACHE.

All content on the Site are the proprietary property of ACHE. You are granted a limited license to access and use the Site Content and to download or print a copy of any portion of the Site Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. You may not upload or republish Site Content on any Internet, Intranet or Extranet Site or incorporate the information in any other database.

You are responsible for ensuring that any materials or photos you post to the Site do not violate or infringe upon the copyright, patent, trademark, or any other personal or proprietary rights of any third party, and is posted with the permission of the owner of such rights. Do not post any material unless you are the sole owner or have written permission of the copyright owner to do so. You may only post photos of yourself. All photos must reflect a professional demeanor.

You agree not to use any obscene or offensive language or to place on the Site any materials or photos that are libelous, abusive, or hateful; constitutes junk mail, unauthorized advertising, or commercial solicitation; invades anyone's privacy; gives rise to civil liability; or otherwise violates or encourages the violation of any local, state, national, or international law or regulation. You agree to use the Site only for lawful purposes.

You agree not to use the Site in any manner that can damage or disable the Site. You may not post or make available any material that contains software viruses or any other programs designed to interrupt, destroy or limit the functionality of any computer software or hardware.

You acknowledge and agree that any information provided by you on the Site is non-confidential and shall become the sole property of ACHE. ACHE reserves the right to the unrestricted use of these submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you. You may request removal of your content from the Site at any time; however, you acknowledge that ACHE retains its rights in the content.

ACHE may terminate your Site access, delete your profile and/or remove any content or information that you have posted (without notice) that in the sole judgment of ACHE violates the Terms of Usage or that might violate the rights, harm, or threaten the safety of others, or for other reasons which need not be disclosed.

You agree to indemnify and hold ACHE, its subsidiaries and affiliates, and each of their directors, officers, agents, contractors, partners, and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of the Site, your conduct in connection with the Site or with users of the Site, or any violation of these Terms of Usage or of any law or the rights of any third party.

The Site contains links to other web Sites ("Third Party Sites"). Such Third Party Sites are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by ACHE, and ACHE is not responsible for any Third Party Sites accessed through the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third Party Sites. Inclusion of, linking to, or permitting the use or installation of any Third Party Site does not imply approval or endorsement thereof by ACHE. If you decide to leave the Site and access the Third Party Sites, you do so at your own risk and you should be aware that our terms and policies no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any web site to which you navigate from the Site.

By visiting or using the Site, you agree that the laws of the State of Illinois, without regard to principles of conflict of laws, will govern these Terms of Usage and any dispute of any sort that might arise between you and ACHE. With respect to any disputes or claims, you agree not to commence or prosecute any action in connection therewith other than in the state and federal courts located in Illinois, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to, venue and jurisdiction in the state and federal courts of Illinois.
